Oscar Pistorius Trial: Not Premeditated?

The judge’s opinion in this case is somewhat straddling two worlds if you ask me. Matt Gutman says the judge doesn’t believe that Oscar was trying to defend himself and Reeva, but that the prosecution’s claim that he intended to shoot her behind the bathroom door also don’t hold water.

What does she believe? I’m curious to hear!

Is she looking to set him free? I’m nervous.

I believe Oscar Pistorius by his own words and the evidence known got into an argument that night with Reeva, and he had a violent temper outburst and killed her in a heat of rage. Did he premeditate the killing as in plan it ahead? No. I don’t believe so.

I believe Oscar Pistorius snapped.

He also didn’t have immediate regrets either as he clearly had no urgency to get her to a hospital quickly. He doesn’t call the ambulance first. No, he calls his friend wasting precious time. That says everything. Did he even try CPR?

I believe Oscar willingly and knowingly murdered Reeva in a fit of rage, and I am very saddened that he will not be convicted of such.

The judge believes he thought he was shooting an intruder, but that he didn’t properly consider his actions. He’ll get culpable homicide. I think this is problematic because I can see myself doing pretty much anything when I’ve just woken up, it’s not a conscious state where you can make normal decisions.

Looks like it’s time for South Africa to go back to jury trials.

Half of the judges explanations didn’t make sense, “even though he shot, he wasn’t trying to intentionally hurt/kill anyone.”

What? With 4 shots into a 15 sq ft bathroom he was trying to miss them?

“He seemed remorseful, sorry … he couldn’t have faked it…”

Every partner who hits their partner immediately becomes the sweetest most loving sorrowful person in the world … right up until the next time.

He wasn’t faking anything (people misinterpreted the nature of the remorse) … he’d snapped and he felt badly about it.

And all the witnesses who heard arguing are all wrong?

Where is this judge coming from?

I’m nervous, too Eyes. The entire PT case, autopsy, ballistics, civilian witnesses just disappeared in a puff of smoke. What a travesty. Don’t know what trial Judge Masipa watched but it wasn’t the one I saw. He’s an angry controlling guy. He snapped and he killed her.

I agree, Eyes. I think he had a red hot temper, and a sense of entitlement, because of his athletic achievements.

Not premeditated, argument in the heat of the moment… And being on valentines day, usually that would lead me to think that a relationship issue came up. http://www.news.com.au/entertainment/tv/oscar-pistorius-exgirlfriend-samantha-taylor-interviewed-on-nines-aca/story-e6frfmyi-1227059314136
The ex confirms his temper and irresponsibility with guns, he really should serve time for this so he can contemplate whtever thwarted issues drove him to lose the plot like this.

Have you seen the interview from Australia with Samantha Taylor? I’d be very interested in what you have to say about her honesty. In absolute shock that he was not convicted of murder. I guess the judge believed his version because the state couldn’t prove theirs. I hope they appeal.

This was a disappointment, but there are plenty of charges that could send him to prison for years. Since, it is totally up to the judge, and she is said to be rather tough, he may spend some time in jail, yet. I can only imagine how the victim’s family feels. I know they feel that her life was worth a lot more than this judge is showing, this far.

I never thought he meant to kill Reeva. I’ve always thought they got into a major argument and she ran to bathroom to get away from him. She wouldn’t open the door; so, he got a gun and shot at the door trying to get it open (like in the movies) and that’s how she was shot.

Then we would see serious remorse. He has none, only pity for himself. I don’t see this even remotely being plausible. His story is also full of holes that do not support this belief at all.
